Yukon Court Upholds Sentence for Calgary Sex Offender

The Yukon Court of Appeal has rejected an appeal by a man challenging his sentence for sexual assault. Rudra Amin, now residing in Calgary, was convicted in 2023 of assaulting three women in Whitehorse between 2017 and 2018. The victims reported the incidents in 2020, leading to Amin’s conviction on four counts of sexual assault following a jury trial.

Following his sentencing, Amin promptly filed an appeal and was subsequently released on bail. In his appeal, Amin sought a reduction of two months from his just over two-year sentence to qualify for a conditional sentence order, citing concerns about potential immigration consequences.

In a ruling issued on Aug. 6, Justice Susan Griffin dismissed the appeal, refuting Amin’s assertions of sentencing errors by the original judge. Griffin also deemed Amin’s request for a conditional sentence unsuitable. She emphasized that Amin’s plea to shorten his sentence lacked merit unless he could demonstrate a fundamental error impacting the sentencing.

Griffin’s decision emphasized that such requests for minor adjustments are beyond the court’s purview, stating, “This is simply tinkering and not this court’s proper role.” Consequently, Amin will serve the original sentence of just over two years for the sexual assault charges.
